“Garuda Indonesia International Photo Contest 2009” is operated by PT. Indo
Multi Media. We are registered in Indonesia under company number 466/SK/MENPEN/SIUPP/1998
and have our registered office at Globe Building 3rd floor, Jl. Buncit Raya
Kav 31-33, Jakarta, 12740. Our PPK number is 000000000.
Please read these Terms and conditions (the Terms) carefully. By entering
(the Garuda Indonesia Photo Competition 2009), you indicate your acceptance
of these Terms, the Privacy Policy, the Code of Conduct and any other notices,
guidelines and rules published by us.
If you do not accept these Terms please do not enter the competition.
PT. Indo Multi Media (we or us) may change the Terms at any time by updating
information on the official Garuda Indonesia International Photo Contest
Website. Please review the Terms regularly to ensure you are aware of any
changes. Your continued access to and/or use of the Site after changes have
been made to the Terms indicates your agreement to be legally bound by the
updated and/or amended Terms.
COMPETITION RULES
The Competition is open to all amateur or professional photographers who
are residents of Indonesia or foreign nationals, except Indo Multi Media
Group employees, Garuda Indonesia or associated company employees and anyone
connected with the promotion.
By entering the promotion, participants agree:
- to be bound by these terms and conditions;
- that their surname and county of residence may be released if they
win a prize;
- that should they win the promotion, their name and likeness may be
used by Indo Multi Media Group and Garuda Indonesia for promotional purposes.
Follow the instructions carefully to enter the
competition, paying particular attention to the advertised closing date.
Entries received after the closing date of the promotion will not be considered
Entrants must supply to Indo Multi Media and Garuda Indonesia their full
name, email address [and daytime telephone number].
Only entries that conform to the stated requirements and conditions of
the competition will be permitted.
Indo Multi Media’s and Garuda’s decision as to the winner(s) is final
and no correspondence relating to the promotion will be entered. Winner(s)
will be notified within 14 days of the close of the competition, unless otherwise
stated.
Prizes will not be transferable. Prizes must be taken as stated and cannot
be deferred.
The name and county of residence of the winner(s) may be obtained by sending
an SAE to Globe Building 3rd floor, Jl. Buncit Raya Kav 31-33, Jakarta, 12740,
within two months of the closing date of the promotion.
Indo Multi Media and Garuda Indonesia reserves the right to amend these
terms and conditions or to cancel, alter or amend the competition at any
stage, if deemed necessary in its opinion, or if circumstances arise outside
of its control.
If the winner is unable to be contacted within two weeks of the promotion’s
closing date, Indo Multi Media reserves the right to offer the prize to a
runner up, or to re-offer the prize in any future competition or promotion.
Indo Multi Media excludes liability to the full extent permitted by law
for any loss, damage or injury occurring to the participant arising from
his or her entry into the competition or occurring to the winner(s) arising
from his or her acceptance of a prize.
We shall not be required to pay or incur any sums to any person or entity
as a result of our use or exploitation of any material entered into the competition.
Competition entrants must NOT:
- include any material that does not belong to you. All material in your
entry must be your own original work.
- infringe anyone else’s rights, including copyright. Your entries must
not violate, plagiarize or infringe the rights of any third party including
any copyright, database, trade mark, trade secret, privacy, publicity,
personal or proprietary rights of any kind.
- contain unlawful or objectionable content. Material that is unlawful,
harassing, defamatory, obscene, offensive, abusive, hateful, inflammatory,
profane, racially, sexually or religiously offensive or otherwise objectionable
or unlawful is not acceptable.
- involve disruptive, offensive or abusive behaviour. Contributions must
be constructive and polite. They may not be contributed with the intention
of invading anyone’s privacy, of being threatening, abusive, offensive,
upsetting or embarrassing or of causing trouble, annoyance, inconvenience
or needless anxiety.
- promote illegal or anti-social behaviour. Contributions must not contain
violent or sexually explicit material or advocate, promote or assist any
unlawful act such as (by way of example only) terrorist acts, copyright
infringement or computer misuse. misrepresent their origins.
- Entrants must not misrepresent their origins and/or names. Submitted
personal details may not be used to impersonate any other person.
The competition is subject to the laws of Indonesia.Lomba ini merupakan
subjek hokum Indonesia.
DISCLAIMER
- Entrants are responsible for all entry related costs including internet
transmission fee, etc
Peserta bertanggung jawab terhadap seluruh biaya yang berhubungan dengan
lomba termasuk biaya internet.
- Winners will be entirely responsible for any taxes or charges related to
the receipt of any prize.
Pemenang bertanggung jawab terhadap biaya yang berkenaan dengan hadiah pemenang.
- On entering the contest, entrants are required to fill out the entry form
correctly, including the spaces for personal information, and submit it to
the organizer. Personal information may be given at the entrant’s discretion,
however failure to provide necessary information may prevent the entry from
being accepted by the organizer.
- Notification to winners
- Names of the winners will also be published on website, printed materials,
and other media where winning photographs are displayed
Untuk mengikuti lomba, peserta diwajibkan mengisi formulir pendaftaran secara
benar termasuk informasi yang bersifat personal, dan didaftarkan ke panitia.
Informasi pribadi tersebut merupakan kebijaksanaan peserta, tetapi informasi
pribadi yang tidak lengkap dan akurat dapat menyebabkan penolakan pendafataran
peserta oleh panitia.
- Pemberitahuan kepada Pemenang
- Nama pemenang akan dipublikasikan di website, media cetak dan media
lainnya dimana foto pemenang ditampilkan.
- Entrants are deemed to have read, understand and agree with all rules and
conditions at the time of submitting. The organizer reserves the right to
rule on any issue(s) not covered and in the event that an entrant should
disagree with any decision made by the organizer, that entrant will have
the right to withdraw his or her entry/entries.
Peserta dianggap telah membaca, memahami dan menyetujui seluruh persyaratan
dan ketentuan lomba yang berlaku pada saat melakukan pendaftaran lomba. Panitia
lomba memiliki hak atas semua keputusan masalah-masalah yang tidak tercantum
dan apabila kemudian peserta tidak setuju dengan keputusan tersebut, peserta
dapat mengundurkan diri dari lomba.
Responsibility / Tanggung Jawab
The organizer is not responsible for any damage or loss that may occur
during the sending of entries via the Internet and any problems or damages
beyond the control of the organizer, such as troubles relating to computer
networks, computer virus infections or unauthorized computer access.
Panitia tidak bertanggung jawab terhadap segala kerusakan yang timbul
selama pengiriman materi lomba melalui internet dan segala masalah yang timbul
diluar kekuasaan panitia seperti masalah yang berkaitan dengan jaringan computer,
penularan virus computer atau akses komputer yang tidak sah.
Entrants must possess the exclusive rights to each entered work and are
responsible for having obtained any necessary permission relating the subject/subject
matter. The organizer will not be responsible for any claims or complaints
against infringement of rights or damages from third parties relating to
the subject/subject matter of entries, and the entrant agrees to indemnify
and hold the organizer harmless in such cases.
Setiap peserta memilki hak dan bertanggung jawab penuh terhadap seluruh
karya foto yang diikutsertakan. Panitia tidak bertangggung jawab terhadap
keluhan atau tuntutan dari pihak ketiga yang merasa dirugikan oleh karya
foto yang dikirim oleh peserta lomba dan peserta wajib untuk mengganti rugi
pihak yang dirugikan dan membebaskan panitia dari segala tuntutan.
Right of Entrants / Hak Peserta
Entrants retain all copyrights and other equivalent rights to entered photographs,
however the organizer will possess rights as stated below in “Rights of the
organizer.”
Peserta tetap memiliki hak cipta karya fotonya, tetapi panitia memiliki
hak yang tersebut dibawah ini dalam paragraph ’Hak Panitia’.
Right of The Organizer / Hak Panitia
The organizer, its subsidiaries and affiliates reserves exclusive right
to publish, reproduce, display, distribute, and show on screen any winning
photograph on Web sites, photo exhibitions, or any other media which is under
the management of the organizer for the purpose of promoting Garuda Indonesia.
In all cases where such photographs are used, the organizer reserves the
right to do so without obtaining the further prior permission of the winner
and without offering any further compensation in any form.
Panitia, cabang dan rekanannya memiliki hak penuh untuk mempublikasi,
memproduksi, memamerkan, menyebarkan, menampilkan di layar seluruh foto-foto
pemenang di website, pameran foto, atau media lain yang berada dibawah manajemen
panitia untuk kepentingan promosi Garuda Indonesia. Dalam penggunaan foto-foto
pemenang tersebut, panitia memiliki hak untuk melakukan tanpa permohonan
izin terlebih dahulu kepada pemenang dan tanpa menawarkan kompensasi dalam
bentuk apapun.
The organizer, its subsidiaries and affiliates reserve the right to (a)
display some or all parts of winning works accompanied by additional effects,
such as computer graphics, sound effects or music on Web sites managed by
the organizer, its subsidiaries and affiliates and (b) to reproduce some
or all parts of the winning works for the purposes of producing announcement
posters, tickets, brochures, etc. for photo exhibitions and other events.
Winners may not exercise any copyright or personal rights to the photographs
used.
Panitia, cabang dan rekanan memiliki hak untuk memajang beberapa atau
keseluruhan karya foto pemenang dengan sentuhan efek tambahan seperti grafis
komputer, efek suara atau musik di website yang diatur oleh panitia, cabang
dan rekanan dan untuk memproduksi bebrapa atau keseluruhan bagian karya foto
pemenang untuk materi promosi yang bertujuan mempromosikan program-program
acara, pameran foto. Pemenang tidak dapat menggunakan haknya terhadap kary
foto pemenang yang digunakan.
In the event that an entry is found to contravene the entry requirements
stated by the organizer, that entry will be disqualified. Entrants will,
however, not be notified of such a judgment. The organizer reserves the right
to revoke winner status and revoke any awarded prize in the event that an
entrant is found to be unsuitable after the prize is awarded.
Bila dikemudian hari peserta melakukan pelanggaran atas persyaratan lomba
yang disebutkan oleh panitia, peserta akan didiskualifikasi dan tidak akan
diikutsertakan dalam penjurian. Panitia berhak menarik kembali status pemenang
dan hadiah dimana pemenang dinilai panitia tidak layak.
All terms and conditions regarding entry to the contest are applied according
to Indonesia legal requirements. In the event that entries are made from
outside Indonesia, such entries will be handled subject to Indonesia law.
Seluruh syarat dan ketentuan yang berhubungan dengan lomba berdasarkan atas
persyaratan menurut hukum Indonesia. Bila peserta berasal dari luar Indonesia,
maka peserta akan ditinjau dari Hukum Indonesia.
It is not the responsibility of the organizer to ensure that the contest
entry re quirements and use of personal information do not contravene the
laws and regulations of the country from which the entry is being submitted.
For the aforementioned reason, all responsibilities relating to the submission
of entries to the contest will be borne by the entrant who, it is understood,
has submitted such entries under their own responsibility and at their own
risk. In the event that any misfortune or damage should be experienced on
the side of the entrant, the organizer will not be responsible. Such damages
will therefore be the sole responsibility of the entrant.
Panitia tidak bertanggung jawab untuk memastikan formulir pendaftaran
dan data informasi personal peserta tidak bertentangan dengan dengan hokum
dan peraturan dimana peserta mendaftarkan diri. Untuk alas an tersebut diatas,
seluruh tanggung jawab yang timbul sehubungan dengan formulir pendaftaran
sepenuhnya menjadi tanggung jawab peserta.
Should any conflict arise between an entrant and the organizer, the case
will fall under the exclusive jurisdiction of the Jakarta District Court
and will be handled and settled accordingly.
Bila terjadi perselisihan antara peserta dan panitia, maka akan diselesaikan
melalui Pengadilan Negeri Jakarta, Indonesia.
Intellectual Property Rights / Hak Cipta:
By entering any form of photograph to the “Garuda Indonesia International
Photo Contest 2009” you agree to grant to the Garuda Indonesia and Indo Multui
Media Group, free of charge, permission to use the material in any way we
want (including modifying and adapting it for operational and editorial reasons)
for usage in web media worldwide (including on our websites accessed by international
users) with particular image size 600x800 pixels in term of 1 (one) year
starting Garuda Indonesia International Photo Contest 2009 launched.
Dengan mengisi formulir “Garuda Indonesia International Photo Contest
2009’, Peserta mengizinkan Garuda Indonesia dan Indo Multi Media Group, tanpa
biaya, izin untuk menggunakan materi dalam berbagai cara (termasuk memodifikasi,
mengadaptasi untuk tujuan operasional dan editorial) untuk penggunaan media
web secara mendunia (termasuk website Penyelenggara yang dapat diakses oleh
pengguna internasional) dengan ukuran tertentu 600x800 piksel dalam waktu
1 tahun terhitung sejak diluncurkannya Garuda Indonesia International Photo
Contest 2009.
In contributing to the “Garuda Indonesia International Photo Contest 2009" competition
you agree to grant both parties mentioned above a royalty-free, non-exclusive
license to publish and otherwise use the material in any way that we want,
and in any media in connection with this competition and any associated promotions
and editorial usage including for web media promotion usage (including on
our websites accessed by international users) with particular image size
600x800 pixels in term of 1 (one) starting Garuda Indonesia International
Photo Contest 2009 launched.
Dengan berpartisipasi dalam “Garuda Indonesia International Photo Contest
2009”, Peserta menyetujui untuk menjamin kedua pihak tersebut diatas izin,
bebas royalty untuk mempublikasi dan penggunaan lainnya materi lomba dalam
berbagai cara dan di media-media yang berhubungan dengan lomba dan promosi
lainnya yang berkaitan dan untuk penggunaan editorial termasuk untuk penggunaan
media web (termasuk website Penyelenggara yang dapat diakses oleh pengguna
internasional) dengan ukuran tertentu 600x800 piksel dalam waktu 1 tahun
terhitung sejak diluncurkannya Garuda Indonesia International Photo Contest
2009.
Pictures submitted and marked as entries to "Garuda Indonesia International
Photo Contest 2009" will only be used in conjunction with the competition
and any associated promotions and editorial usage undertaken by Garuda Indonesia
(or Indo Multi Media Group (IMM) and also for web media usage undertaken
by Garuda Indonesia (or Indo Multi Media) with particular image size 600x800
pixels in term of 1 (one) starting Garuda Indonesia International Photo Contest
2009 launched.
Karya foto yang dilombakan di “Garuda Indonesia International Photo Contest
2009” akan digunakan keperluan lomba dan kegiatan promosi dan editorial yang
berhubungan dengan lomba yang dilakukan oleh Garuda Indonesia (atau Indo
Multi Media Group) serta penggunaan di media web pihak Garuda Indonesia (Indo
Multi Media) dengan ukuran tertentu 600x800 piksel dalam waktu 1 tahun terhitung
sejak diluncurkannya Garuda Indonesia International Photo Contest 2009.
It is important to note, however, that you still own the copyright to
everything you contribute for the “Garuda Indonesia International Photo Contest
2009” and that if your image is accepted as an entry, we will publish your
name alongside it on the Garuda Indonesia and IMM websites as confirmation.
Copyright in your contribution will remain with you and this permission is
not exclusive, so you can continue to use the material in any way including
allowing others to use it.
Penting untuk dicatat adalah Peserta tetap memiliki hak cipta atas semua
yang dikontribusikan dalam lomba “Garuda Indonesia International Photo Conetst
2009” dan nama fotografer akan selalu dicantumkan dalam setiap kegiatan publikasi.
Hak Cipta tetap milik peserta dan izin ini tidak ekslusif, sehingga peserta
dapat tetap menggunakan materi yang dilombakan termasuk pemberian izin kepada
pihak ketiga.
In order that the Garuda Indonesia and indo Multi Media Group can use
your contribution, you confirm that your contribution is your own original
work, is not defamatory and does not infringe any Indonesian laws, that you
have the right to give the us permission to use it for the purposes specified
above, and that you have the consent of anyone who is identifiable in your
contribution or the consent of their parent / guardian if they are under
17 years old.
Garuda Indonesia dan Indo Multi Media dapat menggunakan karya peseta
dan oleh karena itu Peserta harus mengkonfirmasi bahwa karyanya adalah karya
asli milik peserta dan tidak bertentangan dengan hokum Indonesia yang berlaku,
dan peserta memiliki hak untuk memberikan izin untuk tujuan tersebut diatas,
dan peserta dapat menunjuk wali bila usia peserta dibawah 17 tahun.
By entering, entrants will be deemed to have agreed to be bound by these
rules.
Dengan mengikuti lomba, peserta akan diikat untuk menyetujui seluruh

We normally show your name with your entry, unless you request otherwise,
but for operational reasons this is not always possible. We may need to contact
you for administrative or verification purposes in relation to your entry,
or in relation to particular projects.
Penyelenggara akan menampilkan nama peserta disetiap karya foto kecuali
ada permintaan sebaliknya, tetapi untuk kebutuhan operasional tidak selalu
dimungkinkan. Penyelenggara akan menghubungi peerta untuk tujuan pengurusan
admnistrasi atau verifikasi yang berhubungan dengan karya peserta.
In the case of news-related material please note that this may be shared
with the third party media and overseas partners; these are all reputable
news media publishers or broadcasters who are prohibited from altering the
material in any way.
Dalam kegiatan pemberitaan, mohon dicatat bahwa kegiatan ini akan melibatkan
pihak ketiga dimana pihak ketiga tersebut tidak diperbolehkan untuk memanfaatkan
materi-materi lomba dengan cara apapun.
If you do not want to grant Indo multi Media or Garuda Indonesia the permission
set out above on these terms, please do not submit your images to the competition.
Bila Peserta tidak dapat menjamin untuk memberikan izin terhadap point-point
diatas, Peserta diharapkan tidak mendaftarkan diri.
